| Abstract | نظرا لاعتبار فرنسا رائدة أوروبياً وعالمياً في وضع قوانين رادعة لاستعمال المنشطات، تتناول هذه الورقة مفهوم المنشطات الرياضية، وموقف المشرع الفرنسي في قانون الرياضة وتعديلاته ، من التنظيم والرقابة على المنشطات الرياضية من حيث الوسائل الوقائية وطرق الكشف عنها، والإجراءات المتبعة في تقصي هذه الجرائم وكشفها ومدى مراعاتها لحقوق الدفاع. كما تسلط الضوء أيضا على المسؤولية الجنائية المترتبة على الرياضي والمحيطين به في كل ما من شأنه أن يؤدي إلى استعمال المنشطات الرياضية. وبالتالي لا بد من تحديد الأفعال المجرمة، والأشخاص المسؤولين عنها، والجزاءات المترتبة عليها، تأديبية كانت أو جنائية، من عقوبات رئيسية وتكميلية. والظروف المشددة التي قد تقترن بها. وكذلك مدى المعاقبة على الشروع في تلك الأفعال، وفيما اذا توافر سبب للاباحة والتبرير. |

| Alternative Abstract | Given that France is considered a European and global leader in the development of deterrent laws for the use of doping, this paper deals with the concept of sports doping, and the position of the French legislator in the Sports Law (and its amendments) regarding the regulation and control of sports doping in terms of preventive means and methods of detection, and the procedures followed in the investigation and detection of these crimes and their observance of the rights of the defense. It also highlights the criminal responsibility of the athlete and those around him in everything that may lead to the use of sports stimulants. Therefore, it is necessary to identify the criminal acts, the persons responsible for them, and the consequent penalties, whether disciplinary or criminal, including main and supplementary penalties. and the aggravating circumstances that may be associated with it. As well as the extent of the punishment for attempting such acts, and whether there is a reason for their permissibility and justification. |
