Abstractتتلخَّص فكرة هذا البحث في كونه يتناول غرامة التأخير على المدين الموسر وتطبيقها في المصارف الإسلامية القطرية، وتتمحور إشكاليته الرئيسة في: مشروعية الغرامة وتطبيقها في المصارف الإسلامية القطرية، وهذه الإشكالية تقود إلى خمسة أسئلة هي: سؤال المفهوم والمصطلح، والتكييف الفقهي والقانوني وتأثيره في توجيه الحكم الشرعي، والتأصيل الشرعي، والغرامة في ضوء مقاصد الشريعة، وتطبيق الغرامة في المصارف الإسلامية القطرية، ويعتمد البحث على المنهج التحليلي الاستقرائي، والمنهج المقارن. وقد تحقق البحث من دعوى الخلط في مفهوم غرامة التأخير بين العقوبة والتعويض، وتأثير القانون في توجيه اجتهادات الفقهاء المعاصرين في الحكم على غرامة التأخير، ويقيِّم أدلة المجوزين والمانعين لغرامة التأخير، مضيفاً مناقشات واعتراضات على أدلة الفريقين، ويحاول إضافة نظرة كلية مقاصدية على موضوع البحث، كما تميّز ببيان الواقع التطبيقي الذي انتهت إليه المصارف الإسلامية القطرية، ومدى موافقتها للمعايير الشرعية لهيئة المحاسبة والمراجعة للمؤسسات المالية الإسلامية. وقد خلص الباحث في نهاية البحث إلى عدة نتائج تتضمن الإجابة عن أسئلة البحث، كان من أبرزها: أنَّ استعمال الغرامة للتعبير عن تعويض الدائن عن مطل المدين غير صحيح، كما أنَّ تكييف غرامة التأخير في القانون المدني المصري هو تعويض قانوني وفوائد تأخيرية، ولم يعترف به القانون المدني القطري ونقله إلى التعويض القضائي، وقد تأثر المجو زون للغرامة بالقانون من حيث الأخذ بمبدأ التعويض عن المنفعة الذاتية للنقود (الفرصة الضائعة)، وانتهى الباحث إلى القول بمنع غرامة التأخير؛ لأنها زيادة يصعب تمييزها عن الربا، ولو سلمت منه فهي ذريعة قوية إليه، مع ما فيها من زيادة إشغال للذمة متيقن لتحصيل مصلحة مظنونة، وما يترتب عليها من تشويه لسُمعة المصارف الإسلامية، وقد طُرِحَت عدة بدائل لغرامة التأخير لم تسلم من اعراضات، وذهب الباحث إلى البديل القانوني من خلال سنِّ قوانين تحفظ حقوق الدائنين، وتردع المماطلين، وكان الواقع التطبيقي للمصارف الإسلامية القطرية -محل الد ا رسة- الأخذ بغرامة التأخير في صورة التصدق الإلزامي، وقد وافقت في تطبيقها للغرامة المعايير الشرعية، وجميع المصارف تستقطع منها الرسوم الإدارية سوى مصرف الريان.

Alternative AbstractThe subject of this dissertation is the issue of delay penalties on affluent debtors and its application in Qatari Islamic banks. The overarching problem of this research is the legitimacy of delay penalties in the Shari’a and their application in Qatari Islamic banks. This overarching question is answered through five sub-questions: the question of definitions and terminologies, characterization of the issue in Islamic jurisprudence and in the law and its influence in the Islamic ruling on the issue, the penalty in light of the purposes (maqasid) of the Shari’a, and the application of the penalty in Qatari Islamic banks. The research utilizes an inductive, analytical, and comparative approach to studying the issue. The research examines the claim that delay penalties carry both a penal and compensative nature. It further examines the influence of law on modern Islamic jurists’ opinions on the ruling regarding delay penalties, appraising and discussing the evidences and arguments of both the side that deems them permitted and the side that finds them prohibited, while attempting to add an overarching maqasidi light to the subject. The research also includes an examination of the actual application of the issue in Qatari Islamic banks and its compatibility with standards of the Accounting and Auditing Organization for Islamic Financial Institutions (AAOIFI). The research reaches a number of conclusions that include the answers to its questions, including the following: The use of the term “penalty” in reference to the compensation of the creditor for the delay of the debtor is incorrect. In contrast to Egyptian Civil Law, which characterizes delay penalties as statutory compensation and moratory interest, Qatari Civil Law does not recognize such categories and as such characterizes delay penalties as judicial compensation instead. Permitters of the penalty were found to have been influenced by the legal position of allowing compensation on the utility of money itself (wasted opportunity). The research concludes that delay penalties should be Islamically prohibited as they are an increase in the debt that is difficult to distinguish from usury (riba) and, assuming it was distinguishable, remains an easy pretext for usury. It also involves a certain increase in debt in exchange for uncertain lost benefits, the application of which would lead to a negative reputation for Islamic banks. Although they have not been without their own issues, a number of alternatives have been proposed, of which the researcher has been inclined towards a regulatory solution through the imposition of regulations that would preserve the rights of creditors while dissuading the delaying of debts. The solution that was found to be applied in the Qatari Islamic banks under study was the imposition of delay penalties in the form of mandatory charity. Its application of the penalties was found to be compatible with AAOIFI standards. All banks under study were found to cut administrative fees from the penalties with the exception of Masraf Al Rayyan.
