| Abstract | تناولت الدراسة المسؤولية الجنائية لناقل العدوى بالتطبيق على فيروس كورونا، حيث يعد انتشار وباء فيروس كورونا (COVID-19) التحدي الكبير الذي عرفته دولة قطر وكافة دول العالم، وذلك لما يشكله هذا الفيروس الفتاك من خطر جسيم وعدوى متسارعة مما جعله يتطلب مواجهة طبية سريعة وفعالة، إضافة إلى مواكبة قانونية وإجراءات إدارية ملزمة للجميع تحد من انتشاره وتجعل من صحة وسلامة المجتمع أولى الأولويات. وتنتهي الدراسة إلى أنه من أهم الواجبات والإلتزامات التي يتطلبها الوضع، فرض بعض التدابير والإجراءات التي تقع على المصاب كالحجر الصحي والإستشفاء الوجوبي والإمتناع عن مخالطة الغير، أقرباء كانوا أو غرباء حماية لهم من العدوى فإذا قام المريض بمخالفة هذه الإلتزامات عمداً أو عن طريق الخطأ، قامت في حقه المسؤولية الجنائية مما يتطلب تكييف هذه الأفعال وفق النصوص القانونية الواردة في قانون العقوبات لا سيما في ظل غياب نصوص صريحة في القوانين المكملة الأخرى. |

| Alternative Abstract | The study dealt with the criminal responsibility of the carrier of infection by applying to the Corona virus. The spread of the Corona virus – Covid-19 – is the great challenge that Qatar and the whole world have experienced, as it forms a serious danger and accelerated infection. That makes it require a quick and effective medical response, in addition to legal and administrative procedures mandatory for all to limit its spread and make the health and safety of the community the first priority. The study concludes that one of the most important duties and obligations required by the situation is the imposition of some precautions and procedures that fall on the infected person, such as quarantine, obligatory hospitalization, and refraining from contacting with others, whether they were relatives or strangers, to protect them from infection. If the patient violates these obligations intentionally or by mistake, criminal responsibility arises against him / her, which requires adapting these actions according to the legal texts contained in the Penal Code, especially in the absence of explicit texts in other complementary laws. |
